Frequently, the liability insurance adjuster will ask you for a recorded statement following an accident. Should you give them a statement?

The short answer is No. Even if you feel that you have nothing to hide and that you are confident about what happened, the answer is no.

First, you should keep in mind that the liability insurance adjuster is not there to help you with your case, they are not there to increase the value of your case. They are hired to find reasons to deny claims and minimize settlements.

Second, the questions they ask you are confusing, compound and impossible to answer. The questions will also get into your medical past, prior accidents and numerous other topics other than the collision.

Third, the adjuster is not obtaining a statement to help you, they are trying to find inconsistencies which they can use later to either deny your claim or attack your credibility.

Finally, they do not need a statement to open your claim. They don't need a statement to settle your claim.

Your own insurance is a different matter. Now, if the insurance adjuster is from your own insurance company, you may have a "duty to cooperate" and you may be required to provide them with a statement. However, you should consult with an attorney before giving a statement to anyone other than the police.
