JOINT DIVORCE PETITION

The easiest, quickest way that a couple can get divorced in Nevada is through a joint petition, also known as an uncontested divorce. Here are three things to know:
1) A joint petition makes sense when you and your spouse agree on every single term of the divorce, including division of assets, child custody, and support payments. In most cases, judges will sign off on an uncontested divorce without holding a hearing. And depending on the court’s schedule, you could be officially divorced in as quickly as 10 to 15 days after filing.
2) If you and your spouse want to file a joint petition but can’t agree on everything, a mediator could help you settle your differences. A mediator can be costly in the short term, but it is still cheaper than having a contested divorce and possibly a trial.
3) There are disadvantages to filing a joint divorce petition, too. You give up your right to appeal. You give up your right to have a judge make findings, such as what is a fair division of assets. And if you have complicated portfolios, it may be difficult to articulate all the terms of your divorce in a joint petition, which could then lead to litigation down the line. So if you are considering divorce, you are advised to at least consult with your own attorney to discuss whether filing a joint petition is truly in your best interest long-term.
