Hi – my name is Josh Richards and I’m a Digital Forensics Examiner at Sensei Enterprises, located in Fairfax, Virginia.
Today we are going to discuss the impact of digital forensics on legal proceedings.
What is Digital Forensics?
Digital forensics is a forensic science that involves the preservation, forensic analysis and recovery of digital evidence found on electronic devices such as computers and hard drives, mobile phones, tablets, and USB devices.
How are digital forensics involved in legal proceedings?
Digital forensic examiners can be heavily involved with a legal matter. Digital forensic experts often serve as expert witnesses, analyzing electronic evidence searching for information that may be pertinent to the matter. Digital forensic examiners may draft expert reports of their findings, as well as provide expert testimony at depositions, hearings, and trials.
Why is it crucial that electronic data be preserved by a digital forensics expert rather than by individuals or their attorneys?
Preserving the evidence can be the difference between winning and losing a case. When handling original evidence, every action a forensic expert takes is key to ensure that no changes are made to the original evidence, and that no information is destroyed. Digital forensic examiners are properly trained on how to preserve the integrity and authenticity of the evidence.
What are some common misconceptions about digital forensics?
Thanks to the TV show CSI, the largest misconception about digital forensics is that every case can be solved in just a few hours. This is not the reality. The length of time for investigations can depend on many factors. Every investigation follows a detailed process which includes gathering the devices, preservation, collection, analysis, reporting, and presentation of findings.
Another common misconception is that any file ever deleted can be recovered. While it is certainly possible to recover deleted data, it depends on the type of data that was deleted, when it was deleted and whether data wiping software was used to destroy data
