Section 406 in The Indian Penal Code
406. Punishment for criminal breach of trust.—Whoever commits criminal breach of trust shall be punished with imprisonment of either description for a term which may extend to three years, or with fine, or with both.
How do I fight IPC 406?
If false cases under sections 498a and 406 of the Indian Penal Code have been filed against you by your wife, you can defend your case and at the same time file a counter case against your wife.
Section 406 IPC
Section 406 of the Indian Penal Code (IPC), 1860 stipulates the penalties for criminal breach of trust. Section 406 states as follows; that any person who commits criminal breach of trust shall be punished with an imprisonment of a term extendable upto 3 (three) years or fine or both accordingly. The offence of criminal breach of trust is abnormally tried by the magistrate of the 1st class. Furthermore, it is a non-compoundable and bailable offence.
What is considered as streedhan?
Stridhan is, generally speaking, what a woman can claim as her own property within a marital household. It may include her jewelry - gifted either by her family or by her in-laws, gifts presented to her during the wedding or later, and the dowry articles given by her family.
Whatever is given to the wife at the time of marriage and even after the marriage by either side is a part of streedhan. It also includes the articles which she has purchased from her earnings after the marriage. However, the articles gifted to the husband from either side are not a part of streedhan.
