Donald Trump's lawyers are asking the judge who ruled on his hush money trial to lift his gag order
The order was issued in March which bans the former US president from speaking publicly about certain aspects of the case.
In a letter, his team have argued the court's concerns 'do not justify continued restrictions' on his free speech rights.
They claim Mr Trump is unable to defend himself from what they call public attacks.
Prosecutors are pushing for the order to remain in place 'at least through the sentence hearing'.
