National Football League Players Association v. National Football League, 88 F. Supp. 3d 1084 (2015)
The disciplinary policies of the National Football League, or NFL, has been a topic of much debate in recent years. In the 2015 case of National Football Players Association versus National Football League, a federal district court in Minnesota considered whether it could vacate an arbitration award that affirmed the NFL commissioner’s authority to apply a new personal conduct policy on domestic violence retroactively when disciplining a player.
In August of 2011, the NFL and National Football League Players Association, or NFLPA, agreed to a new collective bargaining agreement, or CBA.
Under the CBA, the NFL commissioner was given authority to discipline players for conduct detrimental to the integrity of, or public confidence in, the game of football. If a player disagreed with the discipline, he could appeal to a hearing officer, or arbitrator.
In May of 2014, Minnesota Vikings running back Adrian Peterson inflicted corporal punishment on his son and was later indicted for child abuse. A few months later, a video recording of a domestic violence incident involving Baltimore Ravens running back Ray Rice went viral on social media. In response, the NFL commissioner issued a new personal conduct policy that increased the punishments for domestic violence and sexual assault incidents.
Eventually, Peterson pleaded no contest to a reduced charge of reckless assault, and the NFL advised him it would review the matter for disciplinary action. The NFL then gave Peterson three days’ notice that it was conducting a disciplinary hearing. And when Peterson was unable to attend, the N F L moved forward with his discipline.
In a letter, the NFL commissioner explicitly applied the personal conduct policy and informed Peterson that he was being suspended without pay for at least the rest of the season. The NFLPA appealed on Peterson’s behalf, and an arbitrator upheld the commissioner’s discipline.
Subsequently, the NFLPA filed a petition in the United States District Court for the District of Minnesota to vacate the arbitration award. The court considered the petition.
