Oath On Quran Pak Before Court And Investigation Officer, Legal Aid, Legal Help, LLB Lectures
It is the normal practice in Pakistan that while deciding a criminal case before the investigation officer normally the investigation is completed through special both on Quran. According to the criminal procedure code 1898, there is no provision of taking of special oath on Quran while deciding the fate of a criminal case. And it is illegal to decide any investigation by putting any person in pressure to take oath on Quran. It has been found in different authorities references and precedents that fate of any criminal Case should not be decided by putting any person in pressure to take oath specially to the accused party and it is also not warranted in the investigation and also before any Court of law. The reason behind this law is that it is not decided on a special oath because when a criminal case has been lodged against an accused then the investigation officer is duty bound to decide the case upon the reasoning and upon the evidence only. If any person has failed to produce any evidence then and it cannot be decided without any evidence and there is no provision of law to decide the case specially a criminal case upon a special oath .
