An NRI can claim TDS by filing Income Tax Return in the following scenarios:
1. When his total income is less than the basic exemption limit, then he can claim the refund for the TDS available in Form 26AS.
2. If an NRI sells his properties located in India, TDS will be deducted on the sum received by NRI as per Section 195 of the Income Tax Act. Usually, the deducted TDS will be higher than the tax liability in these cases. So, the NRI can get a refund of the tax which is over and above the tax liability.
However, to avoid the fund’s blockage, an NRI can get a certificate for a lower deduction of tax under section 197 from the jurisdiction assessing officer.
