State v. Davis. | 6 S.W.2d 609 (1928)
Inchoate crimes are incipient crimes that often lead to other offenses. Attempt and conspiracy are two examples. In State versus Davis, the hapless defendant was charged with attempt in a murder-for-hire plot gone wrong.
Carl Davis and his girlfriend, Alberdina Lourie, hatched a plot to kill Alberdina’s husband, Edmon. They planned to live together off the proceeds of Edmon’s life insurance. Davis asked Earl Leverton to find him an ex-convict to murder Edmon. Instead, Leverton shared the plan with police officer Joel Dill. Posing as a former convict, Dill met with Davis. Davis offered Dill six hundred dollars to kill Edmon.
Davis paid Dill the money and gave Dill a photo of Edmon. Edmon used a number of aliases, and Alberdina believed he was a criminal mastermind. Davis arranged for Dill to kill Edmon in the evening as he was leaving the house. But on the night the murder was scheduled, Dill and three other officers went to Edmon’s house and arrested Alberdina and Edmon. Dill and another officer arrested Davis at Davis’s home, where Davis had stayed to give himself an alibi for the crime.
Davis was tried and convicted of first-degree attempted murder. Davis appealed to the Missouri Supreme Court, arguing that the evidence was insufficient to support his conviction.
