Wolf v. Colorado | 338 U.S. 25 (1949)
The framers of the Fourth Amendment were clear in their support of protections against unreasonable searches and seizures, but they failed to mention anything about what should happen if law-enforcement officers violate the amendment. In 1949, the United States Supreme Court considered how this question related to state criminal cases in Wolf versus Colorado.
Without a search warrant, investigators and attorneys with the district attorney’s office in Denver entered the medical office of Dr. Julius Wolf and searched through his medical records to find the names of female patients whom he had seen. After using those records to locate and interview the patients, the district attorney charged Wolf and another doctor with two counts of conspiracy to perform abortions, which were then illegal under state law. Wolf had two jury trials, one for each count. The trial court overruled his objection that the officials from the district attorney’s office had violated the Fourth Amendment by searching and seizing records that subsequently led to the patients’ incriminating testimony. The jury at each of Wolf’s trials convicted him, and Wolf was sentenced to prison.
On appeal, the Colorado Supreme Court affirmed Wolf’s convictions. Wolf successfully petitioned the United States Supreme Court to review his case.
