People v. Fuller | 150 Cal. Rptr. 515 (1978)
The ancient common-law doctrine known as the felony-murder rule has found its way into most American jurisdictions. Its details vary from state to state, and it’s been controversial. The Court of Appeals of California applied, and criticized, the rule in the 1978 case of People versus Fuller.
One Sunday morning, Archie Fuller and an accomplice broke into four vans in a car dealer’s lot, stole the spare tires from each of the vans, and rolled the stolen tires toward their car. When they realized a police officer was watching them, they got into their car and rapidly drove away. A high-speed chase ensued, until the perpetrators ran a red light and struck another car, killing that car’s driver .
Fuller and his accomplice were charged with first-degree murder of the innocent driver. The trial court dismissed the murder charges, and the prosecution appealed.
